General Provisions

73O d.o.o. (hereinafter referred to as “the Company”), as a provider of information society services and seller, sets out these General Terms and Conditions of Business (hereinafter: “Terms and Conditions”) to govern the process of ordering, contracting, delivery, payment, and complaints related to products from its sales range. All products are available via the BODUEL online store, which is hosted on the official website www.boduel.hr  (hereinafter: “Boduel Website”).

Before using the Boduel Website, we kindly ask you to carefully read these Terms and Conditions. By using the Boduel Website, users acknowledge and accept these Terms. The Company reserves the right to modify or supplement the Terms at any time. Any changes will be published on the Boduel Website.

These Terms are an integral part of each individual sales contract concluded via the Boduel Website. They also serve as pre-contractual information pursuant to applicable regulations.

A buyer is any natural or legal person who orders a product listed on the Boduel Website, whether or not they register on the site, and whose order is accepted in accordance with these Terms. A buyer who is a natural person must be of legal age and have full legal capacity. The Company assumes no responsibility for damages caused if a contract is concluded by a minor or a person with limited legal capacity without the consent of a legal guardian or representative.

A user is any person who accesses and uses the Boduel Website via electronic communication tools, regardless of whether they conclude a sales contract through the site. Users may browse the product selection, add items to the cart, and make purchases.

User Account

On the Boduel website, Users have the option to create a user account, although account creation is not a prerequisite for purchasing products. A user account provides Users with a more convenient way to make purchases, track order history, and access special offers and promotions.

A user account is created for one individual only and sharing account information with third parties is not permitted. The User is responsible for safeguarding their account login credentials and is liable for all actions taken through that account. Using someone else’s personal information to create a user account is strictly prohibited.

Users are required to provide accurate, valid, and complete personal information when creating a user account. In case of a breach of this obligation, the Company reserves the right to deny such a User access to, or the use of, all or part of the services or products offered.

Order

Users are able to place orders via the Boduel website. 

The ordering process on the Boduel website involves the User selecting the desired products and confirming the order by clicking on the option “order with obligation to pay.” Upon receiving the order, the Company sends an electronic confirmation to the e-mail address provided during the ordering process. Once the ordered product is ready for delivery, the Customer will receive an order acceptance confirmation via e-mail, which will include information on the expected delivery timeframe.

The Company reserves the right to cancel an order in cases where the ordered products are unavailable or if there has been an error in the displayed product price.

Product and Service Information

The Company strives to provide Users with clear, concise, and easily understandable information about the products available for order through the Boduel website.

Product availability details shown on the Boduel website are for informational purposes only and, due to a high volume of orders, the actual stock status may differ from what is displayed. Therefore, the Company cannot be held liable for any discrepancies in product availability, although it will make every effort to update this information regularly.

If the ordered product is not available, the Company will notify the User without delay via e-mail. The User will be offered the option to choose a replacement product. If the User decides not to proceed with a replacement, the order will be canceled. The cancellation will be confirmed by e-mail.

In cases where the order has already been confirmed and the Customer has paid the purchase price, the Company will issue a full refund of the amount paid, including any delivery charges.

The Company continuously works to update product availability information to ensure it is as accurate and reliable as possible.

Conclusion of the Sales Contract

The sales contract between the Customer and the Company is considered concluded at the moment the Company accepts the Customer’s order and sends an order acceptance confirmation to the email address provided during the ordering process.

Users acknowledge and accept that the Company is not obligated to accept an order if it does not meet the conditions defined in these General Terms and Conditions or other ordering and purchase terms published on the Boduel website.

The product sales contract is a one-time contract, deemed fulfilled upon the delivery of the product by the Company and the completed payment by the Customer, in accordance with these General Terms and Conditions. The contract may be terminated before fulfillment, in line with the provisions outlined in these Terms. The official language of the sales contract is Croatian, and Croatian law shall govern the interpretation of the contract.

Price

The prices of all products displayed on the Boduel website are clearly indicated next to each product, expressed in euros (EUR), and include value-added tax (VAT). The listed prices apply to all available payment methods at the time of placing the order.

The Company reserves the right to change prices at any time without prior notice. Such changes will not affect orders that have already been received and paid for but have not yet been shipped or delivered to the Customer.

In the event of an unintentional pricing error, the Company reserves the right to unilaterally terminate the product sales contract.

Special Sales Promotions

The Company reserves the right, at its sole discretion, to occasionally organize promotional sales, clearances, seasonal discounts, and other special sales formats.

Products included in such promotions will be made available under equal conditions to all Users, or, depending on specific offer criteria, only to those who meet certain clearly defined conditions, including the exact terms and duration of each individual offer.

After the expiration of a promotional sales period, the Company will no longer accept orders under the terms that applied to that specific offer.

Payment Methods

Card Payment (Credit and Debit Cards)

When choosing to pay with a credit or debit card, the transaction is automatically authorized through a card payment platform. All processing fees related to card authorization are covered by the Company.

In case of an unsuccessful authorization, the purchase process will be automatically terminated, and the User will not be able to complete the order. Upon successful payment, the Customer will receive an order confirmation by e-mail, after which the products will be shipped to the selected delivery address.

Online payments using the Corvus Pay system can be made in a one-time payment with the following credit and debit cards: Visa, Mastercard, Maestro, Diners, Discover, and American Express.

Payment via Apple Pay and Google Pay Digital Wallets

When selecting payment via Apple Pay or Google Pay digital wallets, transaction authorization is carried out automatically through the CorvusPay platform.

The combination of Apple Pay and CorvusPay ensures a fast, simple, and secure payment process. Customers simply choose a card from their Apple Pay wallet, and Apple Pay together with CorvusPay handles all sensitive user data. This provides a secure encryption/decryption method that enhances trust in the payment process and significantly reduces online fraud. Apple Pay tokenizes cards within card networks, using a Device Account Number (DPAN) — a virtual card number assigned to a specific device — instead of the actual plastic card. Since the digital signature of the mobile device protects these virtual cards, 3D Secure is not required.

Apple Pay supports payments using cards from the following brands: Visa, MasterCard, American Express, Discover, and JCB.

Online Payment Security Statement

Payments made on our online store use CorvusPay – an advanced system for secure online card payments.

CorvusPay ensures complete confidentiality of your card and personal information from the moment you enter it into the CorvusPay payment form. Payment data is encrypted and transmitted securely from your web browser to the card-issuing bank. Our store never has access to your complete card details.

Even CorvusPay employees cannot access the sensitive data. A secure core system independently transfers and manages all sensitive data, ensuring maximum protection. The payment form is secured with a highly reliable SSL encryption protocol. All stored data is further protected using encryption via a cryptographic device certified to the FIPS 140-2 Level 3 standard. CorvusPay complies with all online payment security requirements set by major card brands, operating in accordance with PCI DSS Level 1, the highest security standard in the payment card industry. For card payments using the 3-D Secure program, your bank verifies both the card’s validity and your identity using a token or password. 

CorvusPay treats all collected information as confidential and uses it only for its intended purpose. Your sensitive data is fully secure, with privacy protected by state-of-the-art security mechanisms. Only data necessary to complete the transaction is collected, in accordance with strict online payment procedures. Security controls and operational procedures applied to our infrastructure ensure real-time reliability of the CorvusPay system. Continuous monitoring, vulnerability testing, and strict access control maintain and improve the system’s security level to protect your card information.

Payment Execution

Payment is considered executed when the payment service provider receives and irrevocably processes the payment order.

Invoice

The invoice will be included in the shipment (in each shipment if the order is delivered in multiple packages) or sent electronically to the e-mail address provided during registration.

Product Delivery Method

Product purchases via the Boduel online store are available within the European Union, Central and Eastern Europe (CEE), the United Kingdom, and the United States of America.

Deliveries are performed by the Company through contracted courier services, on business days only, to the address provided by the Customer when placing the order. Delivery times are defined in the Product Delivery Policy document.

The Company reserves the right to divide an order into multiple shipments if items are stored in different warehouses or if some items are temporarily out of stock. The Customer will not incur additional delivery costs in such cases, as delivery is charged only once, regardless of the number of individual deliveries.

Delivery times start once the Company hands over the ordered products to the courier service.

If the Customer is not present at the delivery address, the courier will leave a delivery notice, and the package can be collected within the retention period defined by the delivery service provider. If the package is not collected within that period, the order will be considered canceled.

Please note: any additional fees the courier may charge due to failure to receive the package (e.g., storage or redelivery fees) are not included in the standard delivery price and are the responsibility of the Customer. These costs depend on the courier’s pricing.

Delivery Fees

The Company charges the Customer for delivery services in accordance with the pricing defined in the Product Delivery Policy. The delivery fee includes packaging for shipping purposes (e.g., protective packaging).

Delivery confirmation

The Customer confirms receipt of the ordered product by signing the delivery document, which is considered proof that the product was delivered in proper and undamaged condition. Once signed, the Company is released from any further responsibility for the condition of the shipment.

From the moment of signature, the risk of accidental damage or loss of the product transfers to the Customer, who then assumes full responsibility for the product.

If the Customer refuses to accept the product without valid reason, the Company reserves the right to charge the direct return costs in accordance with the courier’s pricing. In such cases, the Company may retain all or part of the purchase amount to cover the actual return costs.

Shipment tracking

The shipment delivery process can be tracked via the shipment tracking application provided by the delivery service provider. This tracking service allows the Customer to obtain relevant information about the location and status of the shipment.

However, the shipment tracking service may sometimes be unavailable or only partially available due to technical reasons or other circumstances on the part of the delivery service provider. In such cases, the Company is not liable for the unavailability of this service.

Incorrect delivery and material defects

Customer rights related to material defects are governed by the provisions of the Croatian Civil Obligations Act and other regulations in force at the time of conclusion of the sales contract.

Upon delivery, we kindly ask you to inspect the delivered product and check for any visible external damage to the package and/or to the products inside. If such damage or defects are found, you should immediately report them to the delivery person. The Customer has the right to refuse receipt of visibly damaged products, which will be documented in a delivery report.

A Customer who is not a consumer must notify the Company of visible defects within eight days from the date the defect was discovered, otherwise forfeiting their right to claim. A consumer Customer must notify the Company within two months of discovering the defect, and no later than two years from the transfer of risk to the consumer.

If a product with material defects has been delivered, the Customer has the right to a replacement. If delivery of a defect-free product is not possible, the Customer has the right to a refund of the purchase price and any shipping costs, and must return the defective product. The cost of returning the defective product will be covered by the Company. The Customer must notify the Company of the material defect in writing by post to the Company’s registered address or by e-mail to info@boduel.hr , including the following information:

  • Indication that a defective product was delivered;
  • Attached photographs of the delivered product;
  • Invoice for the ordered products.

Upon receiving the return request, the Company will assess the validity of the claim. If the claim is found to be justified, the Company will provide the Customer with further instructions for the return of the product.

The Company is liable for material defects that existed at the time of the transfer of risk to the Customer, regardless of whether the Customer was aware of them. The Company is also liable for defects that occur after the transfer of risk if they are the result of a cause that existed beforehand.

The Company is not liable for minor material defects.

 

Unilateral contract termination by Customer

A consumer Customer has the right to unilaterally terminate a contract concluded via the Boduel Website without providing a reason, within 14 days. The period starts from the date the consumer or a third party designated by the consumer, who is not the carrier, takes possession of the goods.

However, according to Article 86 of the Consumer Protection Act, in certain situations the consumer has no right to unilaterally terminate the contract, especially if the subject of the contract is:

  • Goods that are perishable or have a short expiration period; or
  • Sealed goods that are not suitable for return for health or hygiene reasons if unsealed after delivery.

Due to the nature of our products, which fall under food items with limited shelf life and hygiene restrictions, returns and unilateral termination of the contract are not possible after the packaging has been opened.

To exercise the right of termination, you must notify us of your decision to terminate the contract before the deadline expires, via an unambiguous statement sent by post to the Company’s registered address or via e-mail to info@boduel.hr, stating your name, address, phone number, or e-mail address. You may also use the withdrawal form available on our website or contact us through our contact form [here].

An example of the withdrawal form available on our website can be filled out electronically and submitted. We will confirm receipt of your contract termination notice without delay via e-mail.

You will be deemed to have fulfilled your return obligation on time if you send the goods back to the Company before the expiration of the 14-day period.

In the event of a valid unilateral termination, we will refund all payments received from you under the terminated sales contract, including delivery costs, without undue delay and no later than 14 days from the day we receive your contract termination notice or the returned goods, whichever is later. Refunds will be made using the same payment method used for the original transaction. If you agree to a different refund method, you will not incur any additional charges.

If you chose a delivery method more expensive than our standard offered option, we reserve the right to refund delivery costs only up to the amount of the cheapest standard option.

The direct cost of returning goods to the Company is borne by the Customer.

You are responsible for any reduction in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functionality of the goods.

Customer complaints

The Customer has the right to submit a complaint regarding the services provided through the Boduel Website via e-mail at info@boduel.hr or by post to the Company’s registered address. The Company will acknowledge receipt of the complaint without delay and respond in writing within 15 days of receiving it.

Additionally, in accordance with the Act on Alternative Dispute Resolution in Consumer Disputes, the Customer may initiate proceedings before the Mediation Centre at the Croatian Chamber of Commerce, Zagreb, Rooseveltov trg 2, mirenje@hgk.hr (link) or before any other body for alternative consumer dispute resolution.

Email communication

Sending messages that contain personal data via e-mail can pose a security risk due to possible unauthorized access by third parties or misdelivery. Users must be aware of these risks and act accordingly with due care.

The Company does not assume responsibility for the security, confidentiality, or content of electronic communications initiated by Users, except to the extent required by applicable data protection regulations.

Personal data contained in such communications will be processed solely for the purpose of handling the request or inquiry and stored in accordance with current data protection laws. These data will not be shared with third parties without a legal basis or the subject’s consent unless necessary to fulfill the Company’s legal obligations.

Liability and limitations of Liability

Users acknowledge the possibility of occasional service interruptions or technical difficulties beyond the Company’s control and accept that the Company is not liable for any potential data loss during internet transmission. Users also accept that access to the Boduel Website may occasionally be unavailable or limited.

The Company applies appropriate technical and security measures to protect data on the Boduel Website and secure user accounts.

The Company strives to ensure the accuracy and currency of all information published on the Boduel Website. However, product characteristics, delivery times, or prices may change and not be immediately updated on the site. In such cases, the Company will inform the Customer of the changes and offer the option to cancel or modify the order.

Users access and use the Boduel Website content at their own risk. The Company is not liable for any direct or indirect, incidental, intangible, or material damage that may arise from access to, use of, or inability to use the Boduel Website, except where such liability is explicitly required by law.

Use of the Boduel website

Content published on the Boduel Website may not be copied, modified, displayed, transmitted, or distributed in any way without the Company’s explicit consent and may only be used for private, non-commercial purposes and individual use.

The content of the Boduel Website is protected by copyright. The Website also contains trademarks and other intellectual property belonging to the Company or third parties.

The Company reserves the right to change any content published on the Boduel Website at any time without prior notice.

Product images displayed on the Boduel Website are for illustrative and informational purposes only and may not fully match the appearance, color, texture, or other features of the actual product. Variations may occur due to screen settings, technical display limitations, or batch differences. Such variations are not considered material defects.

User responsibilities for Content publication and transmission

Users are responsible for obtaining and maintaining their computer equipment and other resources needed to access and use the Boduel Website, as well as for all associated costs. The Company is not liable for any equipment damage resulting from use of the Website.

Users must not publish or transmit any material through the Website that infringes the rights of others, or that is unlawful, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene, or otherwise objectionable. Users may not post advertising or promotional content for any products or services without the Company’s explicit prior written approval.

The Company reserves the right, at its sole discretion, to immediately disable access to any user account found to be in violation of these rules or behaving in a way the Company deems unacceptable or contrary to these General Terms and Conditions.

Users are required to familiarize themselves with these policies before using the Boduel Website, as they apply to all aspects of site usage and the product purchase process.
